General Terms and Conditions
Rights and obligations from the guest accommodation contract
Terms and Conditions in the hotel industry, published by the specialist group Hotels and Related Businesses in the German Hotel and Restaurant Association. V. (DEHOGA)
- If a hotel room is ordered, promised or made available at short notice, a guest accommodation contract has been concluded.
- The conclusion of the guest accommodation contract obligates the contracting parties to fulfil their mutual obligations for the entire duration of the contract.
- The innkeeper's obligation is to keep the room ready in accordance with the order.
- The guest's obligation is to pay the price for the time (duration) of the hotel room order.
- If a guest does not use the ordered hotel room, he remains legally obliged to pay the price for the agreed hotel service, regardless of the reason for the impediment. Only the actual savings of the business must be deducted.
- If the innkeeper can let the unused room to someone else, the guest's obligation to pay the amount of the income earned elsewhere for this period is waived.
- The innkeeper is entitled to cash payment for all services before departure and accordingly has a legal lien on the guest's belongings.
- The place of jurisdiction is the place of business, since even if the room is not used, the services from the guest accommodation contract must be provided at the place of business.
